The National Directorate of Migration of the Argentine Republic, through Provision No. 3025/2020, established as of September 7, 2020, as a new requirement for entry and exit from the Argentine Republic, during the duration of the health emergency due to the coronavirus COVID-19 pandemic, the forms “Electronic Affidavit for Entry to the National Territory” and “Electronic Affidavit for Exit from the National Territory”. In this regard, those who enter or leave the country by air, land, river, or sea must complete an electronic affidavit.
In the case of entries or exits by air, the electronic affidavits must be completed within 48 hours prior to the trip. In cases where entry or exit is by land or sea, the electronic affidavits may be completed at the time of crossing the respective border.
As for the reasons for implementing this new requirement, the National Directorate of Migration stated the following: “… The implementation of an Electronic Affidavit, as a new requirement for entry and exit from the National Territory, will streamline the migration process as well as facilitate the handling of the information provided to health authorities for the care of the population as a whole…”.
People over 70 years old and minors or people with disabilities who cannot complete the electronic affidavits by themselves are exempt from doing so. In such cases, the required data must be completed by the father, mother, or legal guardian on their behalf.
Maritime, river, air, and land transport companies must inform their passengers of the obligation to complete the electronic affidavits, since, according to current migration regulations, they are responsible for the care and custody of passengers and crew until they have passed the migration control examination and entered the Argentine Republic, or verified the documentation upon departure. In case of non-compliance, they may be sanctioned by the National Directorate of Migration with a fine amounting to up to three times the fare on the means of transport used from the point of origin to the point of destination in national territory, at the rate in effect at the time the fine is imposed.
Each citizen entering or leaving the Argentine Republic must report their health status in the Electronic Affidavit, information that will then be sent to the health authorities of the corresponding jurisdiction.
Furthermore, it should be noted that all people entering the Argentine Republic must use the COVID-19-Ministry of Health application in its version for mobile devices, or its web version, for a minimum period of 14 days from their entry into the country.
Procedure to Complete the Electronic Affidavits for Entry and Exit from the Argentine Republic
- Access the following link argentina.gob.ar/interior/migraciones/ddjj-migraciones (“Electronic Affidavit for Entry and Exit from the National Territory”) on the website of the National Directorate of Migration;
- Electronically complete the required data corresponding to the travel document (issuing country, document number, recorded gender, and date of issue);
- Carefully read the terms and conditions established by the National Directorate of Migration, the terms of which are detailed below;
- Accept the aforementioned terms and conditions after reading them;
- Enter the required information in the different sections of the form for both the person traveling and the other members who may be traveling with that person;
- Once the process is complete, confirm the submission of the Electronic Affidavit to the National Directorate of Migration; and
- Each person will receive a copy of the corresponding Electronic Affidavit in their email.
Terms and Conditions of the Electronic Affidavit
“I declare that the data entered in this form is correct and complete and that I have completed this affidavit, without falsifying or omitting any data, being a true expression of the truth.
I declare that I am aware of the penalties established by current legislation for falsifying this document. I declare that I am aware that in the Argentine Republic a public health emergency has been declared by Law No. 27.541, due to the Pandemic declared by the WORLD HEALTH ORGANIZATION (WHO) in relation to the coronavirus COVID-19, for a period of ONE (1) year from March 12, 2020.
I declare that I am aware that upon arriving in the country, having traveled through “affected areas,” I must remain isolated in places or safe areas defined by the national, provincial, and/or municipal government for 14 days from the date of entry into the territory of the ARGENTINE REPUBLIC, refraining from going to my workplace and that I will not be able to move through routes, roads, and public spaces, all to prevent the circulation and contagion of the COVID-19 virus and the consequent impact on public health and other derived subjective rights, such as the life and physical integrity of people.
I declare that I am aware that to protect public health, which is an inalienable obligation of the National State, all people living in the country or temporarily staying in it are subject to the “preventive and mandatory social isolation” measure from March 20, 2020.
I declare that I am aware that during the “preventive and mandatory social isolation,” I must adapt to the phases of isolation management, only being able to move with the corresponding permit issued by the government.
I declare that I am aware that national, provincial, and municipal security forces carry out permanent controls on roads, routes, and public spaces, access points, and other strategic places to ensure compliance with “preventive and mandatory social isolation,” the regulations issued within the framework of the health emergency, and its complementary rules.
I declare that I am aware of the obligation, in case of presenting symptoms compatible with COVID-19, to report immediately to health providers, in the manner established in the health recommendations in force in each jurisdiction.
I declare that I am aware of the option to download and use the free application provided by the National Government on my cell phone to stay informed, control my symptoms, and prevent the spread of the coronavirus for 14 days from the date.
I declare that I am aware that the violation of the measures provided will result in the applicable sanctions according to current regulations, without prejudice to the criminal complaints that must be made to determine the possible commission of public action crimes, as provided in Articles 205, 239, and related articles of the Penal Code.
“Article 205.- Anyone who violates the measures adopted by competent authorities to prevent the introduction or spread of an epidemic will be punished with imprisonment for six months to two years.”
“Article 239.- Anyone who resists or disobeys a public official in the legitimate exercise of their functions or the person assisting them at the official’s request or by virtue of a legal obligation will be punished with imprisonment for fifteen days to one year.”
The Personal Data Protection Law No. 25.326 will apply to the processing of the personal data in this form.”
